Voting Question: What is the Procedural history of St. Paul Fire and Marine Insurance Co. v. Toman?
I am trying to get into insurance sales and I was asked this question by a potential employer after I read a short briefing on the case. I don’t think I don’t think I got it right. Just wondering if I might of said the right thing or not.

Following filing of claim by insured for fire loss under a valued policy, insurer filed declaratory judgment action, asserting that insured had no insurable interest in house at time of fire. The Circuit Court, Sixth Judicial Circuit, Tripp County, Marvin S. Talbott, J., entered judgment in favor of insured, and insurer appealed. The Supreme Court, Hertz, Circuit Judge, held that: (1) though auctioneer was insured seller’s agent in auction of house which was to be removed from his farmstead, this did not establish authorization to execute instrument of conveyance on behalf of insured; (2) sale of the house was not a sale of an interest in land, and thus provisions of the Uniform Vendor and Purchaser Risk Act did not apply; (3) insured seller retained an insurable interest in the house after auction sale but before it was removed; and (4) insured was entitled to prejudgment interest only from the date of refusal of claim and not from date of fire.

Affirmed, with modification as to prejudgment interest.

Plaintiff-appellant St. Paul Fire and Marine Insurance Co., (Insurer) appeals from a declaratory judgment in favor of the defendant-appellee, James T. Toman (Toman). The judgment awarded Toman $28,000.00 under a valued policy issued by the insurer, together with prejudgment interest computed from September 26, 1981, the date of the fire. Insurer claims the trial court erred in the awarded judgment, and in the prejudgment interest calculation. We affirm, and modify the prejudgment interest award.

In a newspaper display advertisement Toman advertised his public auction for September 23, 1981. Among the items listed for sale was a 24 foot by 40 foot house which was to be removed from Toman’s farmstead. Prior to the auction sale, the auctioneer announced that the house had to be removed under terms negotiated by the buyer and Toman.

Carbon Offset – A Great Way To Save The Environment

Carbon offset is a huge help to save the world from the damaging effects of ecological deterioration and global warming by its attempts to reduce carbon emissions in big industries and manufacturing units, as well as at an individual level.

We’ve all seen those late-night TV infomercials about people claiming you can get rich through real estate investing. When I saw one we already owned a couple of properties, but we were nowhere near getting rich. So I figured I’d go and pick up a few tips and tricks. Maybe I could even afford to quit my job in a few years. So I went to the hotel where the free course was being offered on my lunch hour.

They didn’t teach me a darn thing about real estate investing, but they sure had me pumped up and excited to be a millionaire real estate investor. I barely flinched when I paid $2,000 to attend an upcoming weekend course. I could even bring someone at no additional cost! I could already taste financial freedom.

Well, at this one course, I learned a lot. But what I really learned was that I didn’t really know much at all.

They gave me a lot of good information at this course. I got a lot of tools that I could use immediately, but they also convinced me that taking more classes would guarantee my success. Before it was all over, I had spent another $20,000 on real estate investing classes. One of the first assignments that I completed was to flip a property. I also completed two no money down investment purchases. Some people might consider that a success, but it turned out that I had made some bad decisions that haunted me for years to come.

Despite everything I went through, I still believe that a real estate investing class is the best thing for beginners. However, I have some tips to get the most out of this type of class:

– Clearly Define your Objectives. It’s good to know what your objectives are before you go. How much risk are you comfortable with? Are you comfortable being just a landlord, or are you interested in also performing minor (or major) repairs to your property yourself? Do you have a certain dollar amount in your head that you would like to make from your investments? It’s a good idea to write all these down before you go sign up for a course.

– Do your research! A quick online search for real estate investing courses will turn up a lot of options. Go online and look for forums or reviews of the course. Ask friends and family if they know of anyone that has taken a real estate investing course.

– Research the company. You can most likely get information for the company offering the course by mail or on the Internet. Some of the most important information you’ll get is the speaker’s bio. The bio will tell you what makes this teacher qualified to teach the subject. Believe me, people like Robert Allen, Donald Trump, and Russ Whitney do not teach classes like this.

– Leave Your Visa At Home, or At Least Know Your Limits. Before you leave the house to go to the FREE course or the paid weekend on real estate investing, decide what is the maximum amount you will pay for the initial course or any subsequent courses and materials. It’s important to do this BEFORE you attend the course. When you attend the FREE or the less expensive courses, the up-sell is going to be hard to resist, as you will be offered the rock bottom price, but “only if you sign up today”. And every bone in your body might be absolutely convinced that you NEED this to achieve your greatest dreams. If you go in with a threshold of, for instance $3,000, then you can hopefully better control what you actually spend on a future course. Emotion plays a big role in your decision to spend more money, and the programs out there feed on this. Take the “impulse” decision out of the equation by knowing what your objectives are and how much you’re willing to spend to achieve those objectives.

– Take Action! So you found a course that was aligned with your objectives, you met some great people and you’re now armed with some tools and tricks to start building your real estate portfolio. Here’s the key to making your course work for you: Get off your butt and use what you learned!

I met with a few different people at one of the courses I attended and they said this was their 4th or 5th course and they still hadn’t bought anything! I estimated they had spent about $30,000 on courses and did not have anything to show for it – except a fair amount of theoretical knowledge!

Always remember- having knowledge is great, but it won’t earn you any money. It’s only in using what you’ve learned can you ever hope to achieve your goals.

What To Do If Your Bond Is In Default

During hard times, you can sometimes face overwhelming debt. This can make it very difficult to keep up with all your bills.

The National Credit Act went into effect on June 1st, 2007. This introduced something called Debt Counseling or Debt Review. In effect, if you have over-extended yourself financially, this program is there to offer you help. It provides a way for you to restructure your debt. The eventual goal is to meet those outstanding obligations and credit agreements.

One way of doing that is with Debt Counseling. This program was developed to help consumers who simply could not meet their credit agreements and the fundamental living expenses. With this type of program, a debt counselor will negotiate with your creditors, and get reduced monthly payments. Creditors can no longer take legal action once a debt counselor has contacted them. The counselor, working on your behalf, will negotiate with your creditors. They work out monthly payments and usually get interest rates reduced. Debt counselors often charge a fee for their services.

Debt Counseling is one method of doing this. This program is supposed to help consumers who cannot meet their credit agreements and living expenses. A debt counselor will negotiate with your creditors, and work out lower monthly payments for you. In addition, your creditors can no longer take legal action once a debt counselor contacts them. Retiring Rich with Real Estate

I have two younger brothers. And as their older sister, I cannot help but worry about them and their future. It’s my job as the older sister. And lately, I have been worrying about my brother that is closest to me in age.

My oldest brother is a gifted carpenter. He used to be a chef and he was very good at that too. He is also great at rebuilding and repairing cars. His skills, patience and attention to detail are remarkable. However, this is not true when it comes to how he manages his money.

As he is only in his early thirties, he’s happy to keep working for the next 30 years, but I do worry about the fact that he’s only saved a little bit for his retirement. None of us can rely on pensions or government funding to support our retirement anymore so we all should start thinking about our futures today!

So, I decided to make a plan for him. There are probably a lot of ways he could save money, but the big thing I focused in on was the fact that he owns three cars! One of the cars has to go, and with it gone, he will be able to save about $500/month, plus he can add the proceeds of the sale to his savings.

He can also make extra money by taking on extra jobs. These don’t need to be full time jobs- just little side jobs such as kitchen renovations or building fences. Even if he only works weekends, he can have enough saved to put 10% down on a $200,000 house that he can fix up and rent out.

For a couple of years, he can live there while fixing it up and continuing to save more money. Then, he will turn that house into a rental property, renting it out for about $1,400/month. He then buys and moves into a new property that he will call home.

Now, keeping this really simple, lets look at what my brother has when he retires in 25 years:

If his repairs add $25,000 in value and the house appreciates by 4% every year, then in 25 years it’ll be worth approximately $576,743. That means that his original investment has almost tripled in 25 years! Imagine- $1,900 a month of someone else’s money going toward his retirement ($576,000 divided by 25 years divided by 12 months)!

If you’re wondering where the 4% comes from, properties increase in value on the average of 4% every year, even with ups and downs in the real estate market. But even if it doesn’t increase quite that much, the tenants have still paid off the mortgage over the 25 year time span. The rent from the property that he continues to collect (which would be up to about $2,350/month if rent and expenses increase at a 4% rate as well) will go directly toward his retirement.

Also- in 25 years he will have the home where he lives paid off as well. The two properties should give him over $1 million in equity. That’s a nice number for retirement- especially nice when the majority of the retirement savings was contributed by his tenants over the years!

When I explained this to my brother, he sold one of his cars! And with the money he earned helping us with our property, he’s already putting together a nice little down payment for a home.

A Buyer’s agent has a responsibility to know what questions to ask the listing agent prior to submitting an offer. Below are 5 simple but powerful questions for the Buyer’s agent to ask the listing agent prior to writing an offer: These questions will save everyone time and energy.

What bank(s) hold the liens? Banks, lenders and mortgage companies have a reputation in the community as to their “approval” process and time involved in accepting offers. Know the steps banks take in processing offers.

Does only one bank hold the note? A short sale usually means there is not enough money to pay off the first mortgage. If there is a 2nd lien holder there is no money to pay them either, however they have to approve the short sale as does the first lien holder.

Do you have a complete short sale package from the seller? When a seller selects an agent to handle the short sale, the first critical step up front is to complete a short sale package for the lender. Offers will not even be “looked” at by the banks unless this package is complete. The buyer could be in for a long wait while the seller compiles their documents for the bank and the listing agent learns the ropes.

The listing agent should assist the seller in submitting the short sale package to the lender before or at time of listing the property. Banks will not even consider offers until the seller package is complete. The buyer should consider other options if the bank hasn’t received the seller package.

How familiar are you with the bank’s process? This will give you an idea if the listing agent has done any short sale transactions in the past. This process is essential to all parties. Short sales will be around for at a few more years. Asking these questions will better position you and your buyer to a smoother transaction and close of escrow. This time line will ease some of your buyer’s concerns and frustrations.
